Terms of Sale

These terms govern the sale of ADEL products through getadel.com. Placing an order means you accept them. They do not limit your statutory rights as a consumer.

How a contract is formed

Product listings are an invitation to treat, not an offer. Your order is an offer to buy. A contract exists when we send you a dispatch confirmation, not when you receive the order confirmation email.

Because runs are strictly limited, we may be unable to fulfill an order placed within moments of a sell-out. If that happens we cancel and refund in full immediately, and no contract is formed.

Prices and payment

Prices are shown in the currency of the country you select and are set per market rather than converted live. Prices exclude import VAT and duties, which are payable by the recipient on arrival where they apply. Shipping is added at checkout and shown before payment.

ADEL ships delivered at place (DAP) from Montreal. Import duties and taxes are not included in the price and are payable by the recipient where they apply.

Payment is processed by Stripe. We take payment at the time of order.

Limited runs and allocation

Each drop has a fixed unit count published before it opens. We do not restock. We may cap quantity per customer during a drop, and we may cancel orders that appear intended for resale in bulk — with a full refund.

Delivery and risk

Risk passes to you on delivery. Delivery estimates are estimates, not guarantees. See shipping and returns.

Returns and withdrawal

Our 30-day return policy and the statutory 14-day right of withdrawal available to EU consumers are set out in full on the shipping and returns page, which forms part of these terms.

Warranty and statutory guarantee

ADEL products carry a manufacturer warranty described on the warranty page. Statutory consumer rights — including the legal warranty of quality under Quebec law and the two-year legal guarantee available to consumers in the European Union — apply in addition and are not limited by our warranty.

Serial numbers, registration, and resale

Every product carries a unique serial and a one-time activation code. Registration binds the serial to you. Ownership may be transferred through our transfer process; remaining warranty term transfers, but the Registered Warranty term does not renew.

Removing, altering, or defacing a serial voids all warranty coverage on that unit.

Intellectual property

The ADEL name, marks, product designs, photography, and site content are owned by Tyler Pernitsch, operating as ADEL (sole proprietorship) and may not be reproduced without written permission. Buying a product does not transfer any intellectual property rights.

Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded. Subject to that, our liability arising from a product is limited to the price paid for it.

Sport carries inherent risk of injury. ADEL products are sports equipment and must be used with appropriate technique, conditioning, and judgment.

Governing law and disputes

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you retain the protection of mandatory provisions of the law of your country of residence, and may bring proceedings in your local courts.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution before a consumer arbitration board.

Changes

We may update these terms. The version in force is the one published when you place your order.
